New Jersey Superior Court Judge Joseph Falcone dismisses drunk-driving charges against a Zamboni operator even though he tests positive for alcohol. The judge rules that the ice-grooming machines aren’t motor vehicles because they are not street legal.

Yes, but he was still in control of a moving vehicle while intoxicated. Imagine the damage he could have caused with one of those things.

Ha! Does this mean that we can drive anything without motor drunk?? The guy must have done some damage, or he probably wouldn't end up in court...

He could have simply been charged with public intoxication. You can get a ticket for that while you are walking home from the bar. So does this make the driver or the judge the moron?

Lawmowers are not street legal either but you can still get arrested and charged with DUI for it here in SC.

I think the driver's attorney must have exploited a loophole in the law to help his defendant.The loopholes in law are really frustrating.
